1. Eligibility

By using the QistWalay platform, you confirm that you are:

• Legally authorized to enter into binding agreements under the laws of Pakistan.
• Providing accurate, complete, and current information during registration and order processes.

2. User Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, including passwords. You agree to

• Notify us immediately of any unauthorized access or suspicious activity.
• Be held accountable for any action taken using your account, whether by you or someone else.

QistWalay reserves the right to:

• Suspend or terminate your account in case of suspected misuse, misrepresentation, or breach of these Terms.

3. Order Process & Verification

To initiate a purchase on installments, customers are required to submit a complete application and provide the following documents:

• Valid CNIC copy
• Two (2) signed references (on prescribed format)
• Utility bill copy (case-dependent)
• Signed agreement and undertaking
• Advance payment upon delivery (as applicable)
• Post-dated cheques (PDCs) for the tenure of the installment plan (on case-to-case basis)
• Signed delivery note and product image confirmation

Please note:

• Orders are subject to approval post-verification.
• Only one product per CNIC is allowed at any time. Additional orders may be approved based on your payment history and performance.
• QistWalay reserves the right to reject any application without assigning a reason.

4. Cooling-off Period

Customers have the right to withdraw their order any time before signing the official agreement.

5. Product Warranty & Post-Delivery Issues

• Product warranties are offered directly by the manufacturer or their authorized service centers.
• Refurbished items (if applicable) may carry a limited warranty from QistWalay, clearly mentioned at the time of purchase.
• In case of non-functioning products upon delivery, customers must report the issue within 48 hours to both QistWalay and the manufacturer..
• Warranty cards and product boxes may be held by QistWalay until full payment of installments, based on product type and agreement.

6. Insurance

• QistWalay does not provide insurance on any product sold.
• For high-value items such as motorcycles or electronics, customers are strongly encouraged to acquire insurance independently before use

7. Refund Policy

In case of excess payment by the customer:

• The excess will be adjusted against future installments , if applicable.
• If overpayment is made during the final installment , customers may request a refund by contacting support. Refunds will be processed within 45 days .

8. Data Privacy & Information Security

QistWalay is committed to safeguarding your personal data:

• Data is stored on secure, local servers with restricted access.
• Your information may be shared with third-party verification services solely for credit assessment and identity verification.
• QistWalay does not access or require any data from your mobile phone.
• No data is shared for marketing without your explicit consent.

9. Monitoring & Compliance

QistWalay reserves the right to:

• Monitor usage of the website and account activity to ensure compliance with policies.
• Remove or report objectionable content or illegal activity to the appropriate authorities.

10. License & Site Access

You are granted a limited, non-transferable license to use QistWalay for personal purposes only. Any attempt to:

• Commercially exploit,
• Reverse-engineer,
• Resell content,

without written permission is strictly prohibited and may result in account termination.

• QistWalay acts as a facilitator for installment-based purchases. Verification, approval, and delivery are subject to internal checks.
• Product visuals, specifications, and details shown on the website are for reference only and may vary due to manufacturer updates or market availability.
• We reserve the right to correct errors in pricing or description at any time without prior notice.
• Users are encouraged to conduct due diligence before making a purchase.

12. Currency

All prices listed on QistWalay's platform are in Pakistani Rupees (PKR).

13. Limitation of Liability

QistWalay shall not be liable for any:

• Direct, indirect, incidental, or consequential damages,
• Product-related claims post-delivery unless explicitly covered by warranty,
• Delay or failure in performance due to technical, legal, or third-party disruptions.

14. Indemnity

By using our services, you agree to indemnify and hold harmless QistWalay , its affiliates, employees, and partners against any claim, liability, or expense arising from:

• Violation of these Terms,
• Misuse of the website,
• Breach of representations or undertakings.

15. Customer Protection

QistWalay is committed to:

• Prohibiting harassment, coercive collection tactics, or misinformation.
• Providing up to two months of grace period in case of proven financial hardship, subject to approval.

16. Changes to Terms & Conditions

QistWalay reserves the right to modify these Terms & Conditions at any time. Significant changes will be communicated via the website or email. Continued use after modifications implies acceptance of the updated terms

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. In case of any disputes, the courts of Pakistan shall have exclusive jurisdiction.
